General Conditions of Sale

1. Object

1.1 These General Conditions, updated in September 2018, are intended, with the order form, and other elements referred to in them, to regulate the terms and conditions governing the provision of OnTable Online Shop Service ( ON TABLE, LDA), headquartered at Rua Senhor Das Abelheiras, no 60, 4590-106 Paços De Ferreira, under the single registration and identification number of corporate entity no. 514 486 333, hereinafter referred to as OnTable.

1.2 The purchase of any product in the Online Shop OnTable implies the acceptance of these General Conditions of Sale Online.

1.3 Any and all alcoholic beverages available for sale at OnTable Online Store may only be purchased by persons who have the legal age for that, in your country of residence.

2. —Products, Prices, and Content Information

2.1 OnTable reserves the right to modify, without prior notice and at any time, the information and commercial offer presented on products, prices, promotions, commercial conditions, and services.

2.2 The images that illustrate each product in OnTable Online Store may differ from the product later delivered, and the same products are also subject to stock break.

2.3 Despite OnTable’s efforts, some products may have an inaccurate price, which is why the company checks prices whenever it processes orders. Consequently, the prices shown on OnTable Online Store are indicative only and do not constitute a contractual offer. If the effective price of the product is lower than the advertised price, OnTable will refund the difference. If the price is higher, OnTable will inform the customer of such situation by e-mail and will wait for his decision to accept the new price or cancel the order within 15 days counting from the date the e-mail was sent.

2.4 Under Portuguese law, all prices shown on OnTable Online Shop include their respective VAT rates, unless otherwise indicated and for cases legally classified under different VAT rules.

2.5 The promotions published in the OnTable Online Store may not be applicable to physical stores.

3. — Order and Payment

3.1 Upon confirmation of the order in the OnTable Online Store, an e-mail will be sent to the contact address registered by the customer at the time of formalization, with all details about delivery, invoicing, payment information, products, and values. OnTable suggests to all customers to confirm the details of the same. If the customer does not receive the order confirmation email, is required to contact OnTable through the following contacts so the notification can be sent to the customer’s email address again.

3.2 If any of the details placed by the customer in the order are wrong and/or the customer wishes to change some information, as long as the order has not been shipped yet, is required that the customer contact OnTable as soon as possible, through the following contacts, so that the change requested by the customer is made internally. Changes to the details of orders already dispatched will have to be analyzed by OnTable’s team so the most appropriate solution can be found.

3.3 All orders on the OnTable Online Store will only be processed after payment is received. The formalization of the order itself does not constitute a reservation of the products.

3.4 If an order cannot be met in whole or in part, the customer will be immediately contacted by OnTable in order to find the most appropriate solution.

3.5 All orders placed at OnTable Online Store have a maximum payment term of 15 days. After this period, the order will be automatically canceled.

3.6 Orders may be canceled when expressly requested by the customer through one of the following contacts, before the order’s shipment. After confirming the order’s shipment, is required that the customer contact OnTable to find the most appropriate solution, together.

3.7 The payments accepted in OnTable’s Online Shop are ATM Reference, Visa, MasterCard, American Express and MBWAY (both for customers with a bank account in Portugal), Bank Transfer, Paypal.

3.8 Order’s statuses in OnTable’s Online Store are comprised in 3 phases: Pending, Processing, and Completed.
a) Pending – waits for payment entry into the OnTable system;
b) In Processing – Phase in which the payment has already been received, and the order is in processing and preparation;
c) On Hold – waits for additional confirmations with the customer to proceed with the order. Exceptional phase.
d) Finished – the order has already been shipped/sent.

3.9 Payments are received in euros, independently of the currency in which the transaction takes place, the conversion rates of payments made into other currencies will have to be borne by the customer.

3.10 Available payment methods:

a) Bank Transfer

If you choose this method of payment, the customer must send an e-mail to, with proof of transfer and respective reference of the order. The payment will only be validated after confirmation of good collection (confirmation of the value by the bank). After this confirmation, the order will be dispatched.
NOTE: In case of payment by transfer, the delivery time is only counted after the receipt and validation of the transfer.

4. — Shipping Costs

4.1 To the prices shown on the products add the respective value of the shipping, which is calculated based on the sum of two factors: the cost of packaging and the cost of transportation. The cost of shipping depends on the weight of the order and its delivery destination. This port value can be simulated inside the shopping cart with the desired products added and filling all required fields of the simulator. The total shipping costs will also be automatically calculated when placing your order in the Online Store. It should be noted that the factors of this calculation may be variable and may change without prior notice.

5. — Expeditions

5.1 For orders to be sent to the requested address, the customer must choose a sending option – National Shipping (in case of Portugal) and International Shipping (in case of other countries outside Portugal).

5.2 In general, after the expedition, an order made in the OnTable Online Store is delayed to be delivered:
– Approximately 8 days (indicative deadline);
– Door-to-door distribution companies specific to each country.

5.3 After dispatching the orders, the information for tracking the shipment will be available in the account of the customers who have ordered with registration, and a notification is also sent by e-mail with the information of the link to tracking the shipment for all registered and not registered customers. If for any reason the customer does not receive the shipment confirmation, is required that they contact OnTable through one of the following contacts so that all the available information about the shipment of the order is sent again.

5.4 After the notification of shipment, customers must track the shipment through the link provided by OnTable Online Store, so that they are aware of the evolution of shipping status until the delivery since OnTable does not notify each change on the shipping status.

5.5 All products shipped by OnTable must be checked upon delivery. If the customer verifies that the order is damaged, he must return it immediately to the transport company, justify the reason for returning at the delivery note of the carrier, and notify OnTable immediately through one of the following contacts.

5.6 If, after delivery, the customer verifies that any of the articles is not in compliance, they are requested to contact OnTable immediately by e-mail ( indicating the order number or the document number accompanied the order, attaching images of the packaging as received and all articles, so that the process of investigation of the occurrence is opened internally and in this way the situation can be resolved as soon as possible.

5.7 OnTable shall not be liable for shipments made to countries where its law does not allow the entry of alcoholic beverages. It is the responsibility of the customers to seize their parcels, as well as the payment of customs fees if they exist. In case of return of the products, OnTable will only refund the amount corresponding to these same products. In case of doubts, the customer can contact OnTable before ordering.

5.8 OnTable has contracted services with specialized carriers for delivery in Portugal, Europe and most countries in the world. Every effort is made to meet the shipping and delivery deadlines; however, it should be noted that any possible delays in deliveries may be outside of the control of OnTable, and it is not possible in such cases to guarantee the exact delivery times.

5.9 Most deliveries are made during office hours on business days, at the shipping address indicated by the customer when submitting the order.

5.10 In case of an unsuccessful delivery attempt by the transport company due to absence, a transit notice is always left in the customer’s mailbox with the carrier’s information. Depending on the service and the carrier, the packages must be collected in the place indicated by the carrier, in the transit advice note; or the customer must follow the information requested in the same notice.

5.11 If for any reason the customer cannot receive the order or pick it up at the place indicated by the carrier, is requested that the customer contact OnTable so, together, we can find the best solution.

6. — Returns

6.1 OnTable will not accept the return of a product, under the applicable legislation, in the following cases:
a) in the supply of alcoholic beverages which the price of has been agreed at the time of conclusion of the contract of sale, which can only be delivered after a period of 30 days, and that the actual value depends on market fluctuations which cannot be controlled by the professional;
b) In products opened, used, altered or modified.
§ OnTable shall not be liable for deficiencies and nonconformities arising from incorrect use, negligence, poor storage conditions or for force majeure.

6.2 Right of self-determination:
6.2.1 The consumer shall have the right of self-determination within 14 calendar days, without the need to indicate any reason, counting from the day following the day on which the consumer or third party acquires the physical possession of the products.

6.2.2 In order to exercise its right of self-determination, you must notify us of your decision to terminate this agreement, by means of a clear statement or use the standard form for resolution.

6.2.3 In order to respect the period of self-determination, it is enough that its communication, concerning the exercise of the right of self-determination, is sent before the end of the withdrawal period.

6.2.4 In case of termination of this agreement, all payments made, including delivery costs (with the exception of additional costs resulting from your choice of a shipment different from the less expensive mode of normal shipment, provided by us) will be reimbursed to you without undue delay, and in any case no later than 14 days after we have been informed of your decision to terminate this contract. We make these refunds using the same payment method you used in the initial transaction unless otherwise agreed by you. It is up to the consumer to bear the cost of returning the goods.

7. — Applicable Law

7.1 All purchases made on the Ontable’s Online Shop website are subject to the Portuguese Legislation. Any conflict or interpretation divergency of the General Conditions of Sale Online will be submitted to the competent Portuguese Court.

7.2 If the Customer is outside Continental Portugal, OnTable informs, henceforth, that any judicial proceeding must be exclusively established in the Portuguese Courts.

7.3 Pursuant to and for the purposes of the provisions of art. 18 of Law no. 144/2015, of 8 September, it is informed that the available ADR entity is the National Center for Information and Arbitration of Consumer Disputes, with the following contacts:
